Términos y Condiciones

Estos Términos y Condiciones regulan el uso de Nixumi. Al registrarte o utilizar el servicio aceptas estos términos.

1. Descripción del servicio

Nixumi es una consola SaaS para que los negocios operen sus canales de WhatsApp Business Platform: conectar o validar una Cuenta de WhatsApp Business (WABA), administrar plantillas, enviar mensajes de plantilla aprobados, recibir mensajes entrantes y consultar eventos de entrega y webhooks.

2. Cuenta y elegibilidad

Para usar Nixumi debes tener capacidad legal para contratar o actuar en representación de un negocio. Debes registrar una cuenta con datos veraces y eres responsable de mantener la confidencialidad de tus credenciales y de toda la actividad realizada bajo tu cuenta.

3. Uso aceptable

  • No usar el servicio para enviar spam, contenido ilícito, engañoso o no solicitado.
  • No vulnerar la seguridad del servicio ni intentar acceder a datos de otros usuarios.
  • No utilizar Nixumi para fines distintos a operar tus propios canales de WhatsApp Business.

4. Cumplimiento de políticas de WhatsApp y Meta

El uso de los canales de WhatsApp a través de Nixumi está sujeto a las políticas de Meta y de WhatsApp Business Platform (incluidas las políticas de mensajería, de comercio y de plantillas) y a la legislación aplicable. Eres responsable de cumplir dichas políticas y leyes.

5. Responsabilidad del usuario

Eres el responsable de tu propia WABA y números, del contenido de los mensajes que envías y de contar con el consentimiento de los destinatarios. Nixumi es una herramienta que actúa por instrucción tuya; no somos responsables del contenido que decides enviar ni de tu relación con tus contactos.

6. Disponibilidad y "tal cual"

El servicio se ofrece "tal cual" y "según disponibilidad". Procuramos un funcionamiento continuo, pero no garantizamos disponibilidad ininterrumpida ni ausencia de errores. El servicio puede depender de terceros como Meta, Supabase, Vercel y Resend.

7. Limitación de responsabilidad

En la máxima medida permitida por la ley, Nixumi no será responsable por daños indirectos, incidentales o consecuentes derivados del uso o de la imposibilidad de uso del servicio.

8. Suspensión y terminación

Podemos suspender o terminar el acceso al servicio ante un uso que infrinja estos términos o las políticas de Meta/WhatsApp. Tú puedes terminar tu cuenta en cualquier momento eliminándola, conforme a la página de Eliminación de Datos.

9. Ley aplicable

Estos términos se rigen por las leyes de los Estados Unidos Mexicanos.

These Terms and Conditions govern the use of Nixumi. By registering or using the service you agree to these terms.

1. Service description

Nixumi is a SaaS console for businesses to operate their WhatsApp Business Platform channels: connect or validate a WhatsApp Business Account (WABA), manage templates, send approved template messages, receive inbound messages, and review delivery and webhook events.

2. Account and eligibility

To use Nixumi you must have the legal capacity to enter into a contract or to act on behalf of a business. You must register an account with accurate information and are responsible for keeping your credentials confidential and for all activity under your account.

3. Acceptable use

  • Do not use the service to send spam, unlawful, deceptive, or unsolicited content.
  • Do not breach the service's security or attempt to access other users' data.
  • Do not use Nixumi for purposes other than operating your own WhatsApp Business channels.

4. WhatsApp and Meta policy compliance

Use of WhatsApp channels through Nixumi is subject to Meta and WhatsApp Business Platform policies (including messaging, commerce, and template policies) and to applicable law. You are responsible for complying with those policies and laws.

5. User responsibility

You are responsible for your own WABA and phone numbers, for the content of the messages you send, and for obtaining recipients' consent. Nixumi is a tool acting on your instructions; we are not responsible for the content you choose to send or for your relationship with your contacts.

6. Availability and "as is"

The service is provided "as is" and "as available". We aim for continuous operation but do not guarantee uninterrupted or error-free availability. The service may depend on third parties such as Meta, Supabase, Vercel, and Resend.

7. Limitation of liability

To the maximum extent permitted by law, Nixumi shall not be liable for indirect, incidental, or consequential damages arising from the use of or inability to use the service.

8. Suspension and termination

We may suspend or terminate access for use that violates these terms or Meta/WhatsApp policies. You may terminate your account at any time by deleting it, as described on the Data Deletion page.

9. Governing law

These terms are governed by the laws of the United Mexican States.
